Numinosum Festival Regulations

GENERAL PROVISIONS

  1. The organizer of the “Numnosum Festival” (hereinafter: “Festival”) is the Foundation for Landscape Protection and Promotion of Regions “NUMINOSUM” registered in Palmiry, Czosnów 01-052, street Podleśna 19a, figuring in the National Court Register under the number KRS 0000395106, NIP 531-168-75-10.
  2. The festival includes the main part, held from 8/09/2022 to 11/09/2022 in Warsaw:
    • the area of the Festival is situated on the Osiedle Jazdów (Skwer Dialogu Społecznego and Chata Numiniosum, ul. Jazdów 3/5) or in other locations indicated by the Organizer in the Festival. The program is available on the website www.festival.numinosum.pl (hereinafter referred to as “the Program”);
  3. In addition to the main part referred to in item 2 above, the Festival may also include accompanying events.
  4. The locations referred to in points 2 and 3 above are hereinafter referred to (together or individually) as “Festival Area”.
  5. People participating in the Festival are hereinafter collectively referred to as “Participants”, and each individually “Participant”.
  6. The Organizer provides these regulations (hereinafter: “Regulations”) specifying the rights and obligations of the Organizer, including its subordinate services, in connection with the conduct of the Festival, as well as the rights and obligations of the Participants in connection with participation in the Festival.
  7. The provisions of the Regulations are primarily addressed to the Participants, but they also apply to other non-Participants who are on the Festival Area during its duration (e.g. gastronomy employees, media representatives).
  8. The Participant’s right to enter the Festival Area results from his/her ticket (hereinafter: “Ticket”), purchased in the online store on the Festival’s website on the terms and conditions set out in the online store regulations (hereinafter: “Store Regulations”). The organizer may also authorize to participate in the Festival persons invited by him or cooperating with him. The provisions of the Regulations shall apply accordingly to such persons.
  9. The terms defined in the Regulations have the same meaning on the basis of other regulations related to the Festival, including the Store Regulations, unless the context provides otherwise.
  10. The Festival Participant is obliged to comply with the provisions of the regulations and other regulations applicable to specific locations within the Festival, available on their respective websites.

RESTRICTIONS ON ENTERING THE FESTIVAL

  1. It is prohibited to bring to the Festival Area following items: weapons or other dangerous items, explosives, pyrotechnic articles, fire hazardous materials, narcotic drugs or psychotropic substances or other dangerous or prohibited items.
  2. It is forbidden to bring any items that may be used to disturb the course of the Festival or in any other way prevent or hinder the efficient conduct of the Festival in accordance with the script, any sharp or hard, glass, metal objects or clothing elements that in the event of sudden and unexpected contact with the body another Participant may cause damage to his health.

COVID-19

    In connection with the coronavirus pandemic, in 2022, unique rules will apply at the Festival:

  1. The number of Participants will be limited to 200.
  2. The event takes place outdoors.
  3. A trained medical worker and first aid kit will be present at the Festival.
  4. Disinfectants will be available at several marked points.
  5. The number of toilets will be increased and access to running water will be easier.
  6. Festival will be additionally insured.
  7. It is possible to return any purchased festival ticket without giving a reason by 31.08.2022. In this case, the amount of 80 % of the ticket value will be refunded. In the event of the necessity to cancel the Festival for independent reasons, including due to restrictions in force in connection with the Covid-19 pandemic or for other reasons at the discretion of the organizer, the full amount of the ticket will be refunded, minus the costs of bank transfers.
  8. The Festival Organizer will adapt to all sanitary and epidemiological recommendations in power in the Republic of Poland during the Festival. Participants will be notified of the recommendations before arriving at the Festival.
  9. Due to the uncertain epidemic situation, there is a risk of being forced to cancel the Festival. In this case, the full amount of festival tickets will be refunded to the Participants’ account, minus the bank costs.
  10. The decision to come and participate in the Festival is made by each Participant independently and on their own responsibility.

TICKETS AND RULES OF ENTRY TO THE FESTIVAL

  1. Persons with a personal Ticket purchased in electronic form are admitted to the event area, the purchase of which is confirmed by the digital code of each ticket and a document confirming their identity. Details regarding the purchase of Tickets are set out in the Store Regulations available below.
  2. A Festival Participant between the age of 4 and 18 years takes part in the Festival on the basis of his or her own Ticket, however, the condition of admission of such a person to the Festival Area is being under the care of an adult (hereinafter: “Guardian”). The guardian is required to have, and – at the request of authorized representatives of the Organizer – to present, self-signed statement of responsibility for the minor. A sample statement is available below:
  3. In the event that a Participant of the Festival, taking part in the Festival on the basis of their own Ticket, is a disabled person who needs the help of a guardian, then the guardian of the disabled person is obliged to have their own appropriate Admission Ticket to the Festival Area, entitling them to accompany the disabled person.
  4. In the event of a change in the date or venue of the Festival or one or several events within the Festival, the Ticket shall remain valid and have binding force on the new date or place of the Festival.
  5. In the event of cancellation of the Festival or one or several events within the Festival, the Participant is entitled to a refund of the equivalent of the price of the Ticket purchased by him. This does not apply to changes is schedule of the event (concerts or workshops lineup). The Ticket price is a flat-rate price and is not subject to indexation. Amounts incurred by the Participant for handling fees for its Bank as well as any other expenses incurred by the Participant in connection with the Festival (e.g. transport costs and costs of stay in Warsaw) are not refundable.
  6. The purchased Ticket is not exchangeable or refundable, subject to the provisions of items 4 and 5 above, hence the Organizer asks for thoughtful shopping.

HAZARD WARNINGS

  1. The Organizer informs that the Participant or other person staying at the Festival Area may be exposed to constant being in the zone of significant sound intensity, which may cause hearing damage, as well as in the zone of strobe lights and laser effects that may cause visual discomfort. Pregnant women and people with epilepsy are at particular risk.
  2. The organizer informs that during the shows there is a high level of propagation (propagation) of sound waves, to which children under the age of one are particularly vulnerable. In case of any doubts, each of the Participants and the persons mentioned in both sentences above should consult a proper medical opinion before making a decision about staying at the Festival Area.

OTHER RESTRICTIONS

  1. It is forbidden to conduct any commercial activity, as well as to collect money or conduct other activities (e.g. happenings, collecting signatures) on the Festival premises during its course, without the prior written consent of the Organizer.

COMPLAINTS

  1. All complaints, comments and applications on matters related to participation in the Festival may be submitted within 14 days from the end of the Festival, in particular in writing to the following correspondence address of the Organizer: Foundation for Landscape Protection and Promotion of Regions “NUMINOSUM”, Palmiry, ul. Podleśna 19a, 05-152 Czosnów or to the e-mail address: festival@numinosum.pl. The Organizer recognizes complaints within 14 days of their delivery.

MISCELLANEOUS PROVISIONS

  1. At the Festival alcoholic beverages may be sold, served and consumed only in designated places. Sales and administration may only be carried out by entities with the appropriate authorization with the consent of the Organizer.
  2. The Organizer may also record the course of the Festival for the purposes of documentation or for advertising and promotional purposes of the Organizer or sponsors. The organizer or the sponsor, respectively, may use such a recording or its fragment, including the image of the Participant or another person staying at the Festival Area, without time and territorial restrictions, without the need to pay remuneration for using the image in all fields of use, including fields exploitation specified in art. 50 of the Copyright and Related Rights Act, in particular through its consolidation, reproduction, marketing and dissemination.
  3. The Regulations are available on the Festival’s website: www.festival.numinosum.pl.
  4. The Regulations come into force on the day of announcement (Warsaw, 5 February 2022) and are valid until the official end of the Festival by the Organizer, subject to the provisions regarding Complaints.
  5. The number of Participants at the Festival is limited.

GENERAL REGULATIONS OF WORKSHOPS

  1. These regulations apply to workshops organized as part of the Festival. The schedule and location of the workshops is specified in the Program.
  2. Only people who are Participants of the Festival and have purchased a Ticket covering admission to the given workshops have access to specific workshops. The above does not apply to persons authorized by the Organizer.
  3. It is prohibited to:
    • take drugs and intoxicants
    • sale any products and services
    • smoke cigarettes and e-cigarettes
  4. Tickets for the Festival or any of its parts are not sold in the workshops.
  5. Compliance with personal culture, accepted moral and social norms is obligatory within the workshops.
  6. The number of places at the workshops is limited.
  7. The provisions of these Regulations do not exclude the provisions of the Regulations (Festival).

SHOP REGULATIONS

Scope of Application:

  1. These regulations apply only to the sale of Tickets via the website : www.festival.numinosum.pl.

ONLINE SALES

  1. Tickets are sold and distributed by the Festival Organizer: Foundation for Landscape Protection and Promotion of Regions “NUMINOSUM” with headquarters in Palmiry, Czosnów 01-052, street Podleśna 19a, entered into the National Court Register under the number KRS 0000395106, NIP 531-168-75-10.
  2. The sales contract between the Tickets Buyer and the Organizer is concluded if the required ticket purchase procedures are met at www.festival.numinosum.pl:
    • for the Buyer to place an order online by adding selected items to the cart
    • for the Buyer to provide the required personal data and for the Buyer to pay for the order by bank transfer within 7 business days of receipt of the order confirmation from the Organizer (via e-mail).
    • about the receipt of the transaction confirmation by the Buyer to the e-mail address provided by the Buyer
  3. By purchasing Tickets in the online system, you accept the Festival Regulations, the Regulations of the workshops and the Regulations of the Store.
  4. When purchasing Tickets online, payments are made by bank transfer.
  5. The Ticket Price does not include any fees incurred by the Buyer towards its Bank, including transfer costs, which are incurred by the Buyer.
  6. The tickets remain the property of the Organizer until the Organizer’s bank confirms the receipt of the funds corresponding to the entire price of the Ticket selected by the Buyer.
  7. Pursuant to the Regulation of the Minister of Finance of 26 July 2010, the sale of tickets in the scope of ordering and payment via the Internet is not subject to fiscalisation, therefore the Buyer does not receive a fiscal receipt.
  8. Persons making payments via a foreign bank should take into account the costs of bank brokerage, because only payment of the full price of the selected Ticket within the set deadline guarantees the Organizer’s performance of the order.
  9. The Buyer prints the Ticket after confirmation of the order by the Organizer. Each Ticket is identifiable by means of an individual number and individual bar code. Checking the Ticket involves either checking the individual number or scanning the individual bar code – at the discretion of the Organizer or persons authorized by him. In addition, the Organizer may ask the presenting Ticket to provide the name of the Ticket Buyer. The above provisions do not exclude the application of internal regulations applicable to individual Festival locations.
  10. The organizer reserves the right to terminate online sales at any time, without giving reasons.
  11. The organizer is not responsible for the consequences of providing false or incorrect data in the order form.
  12. The number of tickets sold is limited.
  13. The organizer may or may not sell tickets at the Festival.

COMPLAINTS, RETURN AND EXCHANGE OF TICKETS

  1. In the event of a change in the date or venue of the Festival or one or several events within the Festival, the Ticket shall remain valid and have binding force on the new date or place of the Festival.
  2. In the event of cancellation of the Festival or one or several events within the Festival, the Participant is entitled to a refund of the equivalent of the price of the Ticket purchased by him. The Ticket price is a flat-rate price and is not subject to indexation. Amounts incurred by the Participant for handling fees for its Bank, as well as any other expenses incurred by the Participant in connection with the Festival (e.g. transport costs and costs of stay in Warsaw) are not refundable.
  3. The purchased Ticket is not exchangeable or refundable (except regulation in chapter TICKETS AND RULES OF ENTRY TO THE FESTIVAL), hence the Organizer asks for thoughtful shopping.
  4. All complaints regarding the sale of Tickets must be reported within two business days of purchasing the Ticket to the email address festival@numinosum.pl. The organizer shall consider complaints regarding the sale of Tickets within 7 days of receipt of the application.

BUYER DATA PROTECTION

  1. By providing data in the online sales system, the Buyer agrees to the Organizer’s storage and processing of the Buyer’s personal data in order to complete the order, the necessary contact with the Buyer and for all activities necessary for the functioning of the Ticket sales system.
  2. The storage and processing of personal data received takes place in accordance with the principles set out in the Personal Data Protection Act (Journal of Laws of 2002, No. 101, item 926, as amended) and in the Act of July 18, 2002. on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204).

FINAL PROVISIONS

  1. Tickets purchased via the Festival website may not be copied, processed or scanned.
  2. The Organizer is not responsible for the functioning of the Internet network, through which the Purchase of Tickets is made by the Buyer. The organizer is not responsible for messages or other data lost or lost on the Internet, individual computer settings and how they are configured, as well as settings or interruptions in the provision of services occurring at Internet access providers.
  3. The Organizer is not responsible for the Buyer’s loss of the code confirming the purchase of the Ticket.
  4. A ticket purchased by the Buyer and printed entitles to enter the Festival, to the appropriate extent, the number of persons indicated on the Ticket.
  5. The ticket authorizes one-time admission to the events indicated therein.
  6. The Buyer provides the Ticket to third parties at his own risk.
